What is Rape?
First let's see what the bible says concerning rape in Deuteronomy 22:25-29 "But if a man find a betrothed damsel in the field, and the man force her, and lie with her: then the man only that lay with her shall die. But unto the damsel thou shalt do nothing; there is in the damsel no sin worthy of death: for as when a man riseth against his neighbour, and slayeth him, even so is this matter: for he found her in the field, and the betrothed damsel cried, and there was none to save her. If a man find a damsel that is a virgin, which is not betrothed, and lay hold on her, and lie with her, and they be found; Then the man that lay with her shall give unto the damsel's father fifty shekels of silver, and she shall be his wife; because he hath humbled her, he may not put her away all his days" (KJV).
So rape can be of two types, according to the above scripture.
- Rape that has to do with a betrothed damsel (a woman who is engaged. That is about to get married).
- Rape with a non-betrothed virgin damsel (a single lady that is a virgin).
Please we'll advise, that not all rape cases are actually rape cases.
Then what is Rape??
Rape is a forceful sexual intercourse with a person (male or female) without the persons consent. The spirit behind rape is demonic, that is why they were told to stone them to death if found in the books of Deuteronomy.
It is also important to note that the males are also subject to rape too. So it is not a one sided thing, though it isn't as rampant as that of the females.
Also note that, rape could occur between married couples. Remember that rape is a forceful sexual intercourse. In a situation where the man is in need of sex, and the woman isn't in the best situation to comply, and then the man (which is her husband) forces her out of her own will, all to satisfy his selfish desires becomes rape and not sex.

So back to the point, where we mentioned that, not all rape cases are rape cases!!
Whoa.....yes, but how??
Let's take a look at the same Deuteronomy 22:23-24 "Suppose a man is caught in a town having intercourse with a young woman who is engaged to someone else. You are to take them outside the town and stone them to death. She is to die because she did not cry out for help, although she was in a town, where she could have been heard. And the man is to die because he had intercourse with someone who was engaged. In this way you will get rid of this evil" (Good News Bible).
Okay, did you take note of cry out for help?
So on this basis, we'll be establishing a fact here.
What actually qualifies a rape situation?
- Rape cannot take place in the open (public). It is usually done in hidden places, at odd hours of the night. Now if you take a look at the above verse, you will see the condition why the woman should be stoned to death. It's because it's a town (a busy place) where so many activities takes place, so if she cries for help, definitely people will hear her. And this leads us to the next point,
- Rape isn't a consensual thing (agreement between the two persons). But when it becomes a consensual thing, then it isn't a rape case. So in support of No. 1, the possible reason why they feel the woman should be stoned to death is because, they think it was a consensual thing due to the fact that she was in a town where she could scream, shout for help and people will come to her rescue, but she didn't. So it therefore means it was all planned (setup) by the two parties.
- A person (male or female) who is about to be raped (at the scene) could possibly shout for help. But there are cases where they cover their mouth and all that. But still, there should be a sign of struggle, (which could be in form of bruises).
- In expansion of 2 & 3 above, there could be a situation where it becomes a setup (trap). This isn't considered rape. A setup in the sense that, we humans, we are desperately wicked and would do anything we can, when we become obsessed with a thing. And this thing could possibly be a person too. In this kind of situation, it is best for the person in charge to evaluate the situation carefully with the help of the Holy Spirit.

Insightful post, thanks.
